TIP Amendments to be considered at the August 24, 2023, meeting of the GTC Board

SUBJECT:     FFYs 2023-2027 Transportation Improvement Program Amendment Requests / Proposed Council Resolutions 23-18 through 23-25


The City of Rochester, Monroe County, and NYSDOT have requested changes to the FFYs 2023-2027 TIP. The TIP Development Committee (TDC) reviewed the proposed changes on July 20, 2023 and recommends favorable action for Proposed Council Resolutions 23-18 through 23-25.

Like we do at the end of every Federal Fiscal Year (FFY), GTC and NYSDOT staffs worked to determine if any projects have phases that need to defer from FFY 2023 or FFY 2024. We also endeavor to program all the available funding from the current FFY. The requested changes exceeded the funding available so not all requests could be fulfilled. Of note, the City of Rochester’s request for the Genesee Street Reconstruction project is not fully funded and the estimated cost increases for Monroe County’s share of the Regional Traffic Operations Center in FFY 2024, 2025, and 2026 are not funded. There is potential for additional federal funds to be added to these projects should they become available.

The proposed changes were vetted through the TIP Development Committee (TDC), including refinements made after their July 21 meeting and there were no objections raised.

After materials were sent to the TDC, NYSDOT identified that the Detailed Design phase of the Rt 204 (Brooks Ave), 33A to Rochester City Line project will not be able to advance in the current FFY as programmed. They have requested the phase be deferred to FFY 2024 with a $1,000 placeholder of NHPP funds while they advance the phase with State funds. Relatedly, the ROW Acquisition phase also needs to be deferred from 2023 to 2024 and requires $40,000 of NHPP funds. NYSDOT has reduced their request for the Route 14 over CSX Bridge Deck Replacement project to offset this change. Deferring these phases provides additional FFY 2023 capacity for the City of Rochester’s project as all other FFY 2023 requests are funded. The TDC has not had an opportunity to consider this change so there is no associated recommendation.

Note: The proposed changes were presented and recommended by the GTC Planning Committee on August 10, 2023.

Recommended Action:

Approve proposed Resolutions 23-18 through 23-26, amending the FFYs 2023-2027 TIP.

Change in Project Schedule

  1. Proposed Council Resolution 23-18 (Amending the FFYs 2023-2027 TIP by deferring phases of the Rt 414 over CSX Bridge Rehabilitation project)

(TIP # B17-29-WA2, PIN 441408) – NYSDOT

Defer a FFY 23 Construction phase of $2,282,300 ($1,825,800 Federal) to FFY 25;

Defer a FFY 23 Construction Inspection phase of $228,000 ($182,400 Federal) to FFY 25.

The source of programmed Federal funds is the Safety Transportation Block Grant – Flex, managed by NYSDOT Main Office.

At the October 20, 2022 TDC meeting, Region 4 reported that the Railroad Force Account Agreement was not provided by CSX at the time of PS&E and that project progress was delayed indefinitely. As of the current time, the Railroad Force Account Agreement continues not to be available.

 

  1. Proposed Council Resolution 23-19 (Amending the FFYs 2023-2027 TIP by deferring phases of the Large Culvert Replacement/Rehabilitation project)

Defer a FFY 24 Construction phase of $6,283,000 ($1,884,900 Federal) to FFY 25;

Defer a FFY 24 Construction Inspection phase of $628,000 ($502,400 Federal) to FFY 25.

The sources of programmed federal funds are the National Highway Performance Program and the Surface Transportation Block Grant - Flex, managed by NYSDOT Main Office. The project schedule is updated based upon the consultant provided work plan.

 

  1. Proposed Council Resolution 23-20 (Amending the FFYs 2023-2027 TIP by increasing the Total Cost of the Large Culvert Replacement/Rehabilitation Project)

Defer a FFY 24 Construction phase of $1,433,100 ($456,000 Federal) to FFY 25;

Increase a FFY 24 Construction Inspection phase of $142,900 ($125,600 Federal) to $1,515,000 ($1,212,000 Federal);

Defer a FFY 24 Construction Inspection phase of $1,515,000 ($1,212,000 Federal) to FFY 25.

The sources of programmed federal funds are the National Highway Performance Program and the Surface Transportation Block Grant - Flex, managed by NYSDOT Main Office. The project schedule is updated based upon the consultant provided work plan.

 

  1. Proposed Council Resolution 23-21 (Amending the FFYs 2023-2027 TIP by deferring phases of the I-490 Bridges over Erie Canal and Kreag Rd project)

(TIP # B17-64-MN1, PIN 449016) - NYSDOT

Defer a FFY 23 Construction phase of $47,500,000 ($28,234,500 Federal) to FFY 24;

Defer a FFY 23 Construction Inspection phase of $4,750,000 ($3,060,000 Federal) to FFY 24.

The sources of programmed Federal funds are the National Highway Performance Program (Planning Target), the National Highway Freight Program (Main Office), and a repurposed earmark. There is no increase in Federal Share.

NYSDOT requests to defer the project to allow the NYSDOT Design Bureau to explore work zone traffic control options based on new traffic counts. This effort could result in significant cost savings to the project but will impact the project delivery schedule.

NYSDOT Main Office has agreed to manage fiscal constraint. To accomplish this, the fiscal constraint table shows a dollar-for-dollar swap of FFY 2023 NHPP funds from the regional Planning Target and FFY 2024 NHPP funds from statewide balances.

 

Change in Project Cost

  1. Proposed Council Resolution 23-22 (Amending the FFYs 2023-2027 TIP by increasing the Total Cost of the Genesee Street Reconstruction project)

(TIP # H20-15-MN1, PIN 4CR015) – City of Rochester

Increase the Total Cost from $4,999,900 ($3,714,900 Federal) to $8,010,800 ($5,248,900 Federal);

Increase a FFY 23 Construction phase from $4,295,700 ($3,151,600 Federal) to $7,000,000 ($4,456,000 Federal);

Increase a FFY 23 Construction Inspection phase from $693,400 ($554,700 Federal) to $1,000,000 ($784,300 Federal).

The source of programmed Federal funds is Surface Transportation Block Grant – Large Urban. The sources of additional Federal funds are Surface Transportation Block Grant – Large Urban and Surface Transportation Block Grant – Flex from Available Balances. The increase is based upon rising labor and material costs, added accomplishments such as traffic signal work and unforeseen public fiber optic relocation, and the need to increase the construction duration from one to two seasons.

The Federal Share is 75% per the overmatch included on the City’s TIP application. The overmatch for all phases is consolidated on the Construction phase.

The source of programmed Federal funds is the Surface Transportation Block Grant – Flex. The offset is requested from Available Balances. The 2022 increase reflects the actual costs while the 2023 increase reflects the latest estimate.

GTC staff recommends that the GTC Executive Director be authorized to take necessary actions to amend the 2023-2027 TIP, as appropriate, to make any future Project Cost or Project Schedule changes to BRIDGE NY projects, per Exhibit 4 of the TIP Procedures Manual, as Staff Modifications without any subsequent action by the GTC Board for these projects.
